Does This Tweet From a Former Obama Aide Mean That Dems Are Panicking About Trump?

Barack Obama’s former speechwriter admitted that Joe Biden isn’t heading toward victory in this election cycle. Jon Favreau tweeted that Donald Trump would win if the election were held today. The Biden administration has been saddled with an endless stream of bad news. 

No one listens to him abroad because he’s a foreign policy dunce, and no American voter believes him at home. Sure, the man has experience being a fixture in Washington for decades, riding on an unimpressive career in public life and being dead wrong on every major American foreign policy venture. Case in point, if it were up to Biden, Osama bin Laden would still be alive. The then-VP did not support Obama’s raid to eliminate the world’s most wanted terrorist.

What’s odd about Favreau’s thread is this political call to arms. We need to get involved and persuade those sitting on the fence. Again, who are these people? As in 2016 and 2020, everyone has decided who they will vote for in November. 

“Campaigns and strategists and organizers don't use polls and focus groups to figure out if they're winning. They use them to figure out how to win - how to persuade people who still haven't made up their minds,” he wrote. 

Yes, and all the battleground polls show that Biden is losing. Young voters, Blacks, Hispanics, union workers, and Muslim voters aren’t high on this dementia-ridden disgrace of a president. I do take the line that Democrats can’t rely on the media or the courts to bail them out, a tacit acknowledgment that this group hoped the legal drama could damage Trump. No one trusts the media, either. It’s about Biden, his record, and whether he has the juice to gin up the Democratic base organically. Thus far, he’s been incapable of doing that because he’s too old.

American Right Finally Wake Up?

Like many others in the punditry space, I am a lawyer by background. I practiced law at a major global law firm. I clerked for a judge on the U.S. Court of Appeals for the 5th Circuit. I have published multiple pieces of formal legal scholarship on constitutional issues. I regularly lecture at law schools and present to professional lawyer groups across the country on assorted legal topics. I host two shows, one of which is explicitly legal-based -- and with a focus, above all, on the unprecedented lawfare tactics sullying the 2024 presidential race.

In other words, I know a thing or two about the law. And I have been doing my part to sound the alarm on Manhattan District Attorney Alvin Bragg's sham prosecution and eventual show trial of former President Donald Trump ever since the George Soros-backed lawman first dropped his ludicrous 34-count indictment over a year ago. There are far too many technical deficiencies in Bragg's "case," to say nothing of the grotesque manner in which the presiding judge comported himself at trial, to recapitulate here.

But for present purposes, the key point is this: None of those details matter. (SET ITAL) None of them. (END ITAL)

The key points following Thursday's first-ever criminal "conviction" of a former U.S. president, rather, are three-fold.

First, the Democrats' long march to get the nefarious Orange Man by any means necessary, beginning with the 2016 election cycle, has finally worked. There was the Russia collusion hoax -- birthed by the failed Hillary Clinton campaign and laundered through Fusion GPS and the tiny law firm Perkins Coie LLP. There was the illegitimate spying on Trump campaign hands like Carter Page. There were the Democrats' street hooligans, from the Women's March of 2017 through the Antifa-Black Lives Matter riots of 2020. There was the constant deep state undermining of the presidential agenda. There were two bogus impeachments -- for an entirely inconsequential phone call with the Ukrainian president, and for the Jan. 6, 2021, U.S. Capitol jamboree that transpired mere days before Trump was set to leave town anyway. Most recently, there was the Aug. 2022 predawn FBI raid at Mar-a-Lago, and all the multistate lawfare that has followed.

And now, here we are.

Second, American patriots of all political stripes must come to terms with the current fallen state of the nation. The prosecution and incarceration of political opponents on trumped-up (no pun intended) charges is third-world, tinpot dictatorship, banana republic-type stuff -- pure and simple. Americans sometimes read about foreign nations whose partisans succumb to their basest instincts, in terms of attempting to jail political opponents. Indeed, it almost has the whiff of a medieval setting -- a king deposes his archrival and then condemns the vanquished foe to rot in the Tower of London. The idea that jailing one's top political rival -- and in an election year, no less -- could ever happen in the land of the free and the home of the brave would have struck many of us in the not-so-distant past as too ludicrous an idea to even contemplate. But as Sen. Josh Hawley (R-Mo.), no legal slouch himself, tweeted after the verdict, "If you thought it couldn't happen in America, you were wrong."

Once again, then, here we are.

Third, it has never been more incumbent upon the Right to (SET ITAL) finally (END ITAL) wake up and realize what is going on right now in this once-great nation. Many conservatives and Republicans like to wax nostalgic about blindfolded Lady Justice -- about neutral enforcement of the law, and about general norms of liberal neutrality. Will those on the Right finally wake up and realize where, exactly, our attempt to seize an unsustainable faux-moral high ground has gotten us? The imperative of this late hour of the American republic, in order to even attempt to rebalance our wildly off-balance pendulum, is to respond to the Left as it has acted toward us: by wielding political and prosecutorial power to reward friends and punish enemies -- to reward our side's forces of civilizational sanity and punish their side's forces of civilizational arson -- within the broad confines of the rule of law.

If we want to get back to "neutrality," at this perilous point, it's going to first take bloodying up some noses. That is unfortunate for those Americans who actually do value and cherish neutral enforcement of the rule of law. But yet again, here we are.

Above all, it is imperative that the Right not bat an eyelash. Do not be intimidated by this blatant show of crass thuggery masquerading as a legal proceeding. It's now full steam ahead through November. We must make these miscreants pay for what they have done.

'Full-Blown Freakout,' Democrats Are Having a Panic Attack Over Joe Biden's Electoral Prospects

How bad are things for Joe Biden at this point in the election cycle? They are so bad that Politico put no less than five reporters on a story detailing the "full-blown freakout" occurring within the Democratic Party over the president's re-election prospects. 

That's not hyperbole on my part. "Dems in full-blown 'freakout' over Biden" is the headline of the piece.

A pervasive sense of fear has settled in at the highest levels of the Democratic Party over President Joe Biden’s reelection prospects, even among officeholders and strategists who had previously expressed confidence about the coming battle with Donald Trump.

All year, Democrats had been on a joyless and exhausting grind through the 2024 election. But now, nearly five months from the election, anxiety has morphed into palpable trepidation, according to more than a dozen party leaders and operatives. And the gap between what Democrats will say on TV or in print, and what they’ll text their friends, has only grown as worries have surged about Biden’s prospects.

A quick check of the polling average shows that Biden has only led in one of the last eight polls, with the president posting just a single-point advantage according to Quinnipiac. Given the dynamics of the electoral college, which suppose a three to four-point lead would be necessary for Biden to prevail, that's simply not going to cut it.

No Democrat wants to be the one to admit it publicly, though they all know it. 

“You don’t want to be that guy who is on the record saying we’re doomed, or the campaign’s bad or Biden’s making mistakes. Nobody wants to be that guy,” said a Democratic operative in close touch with the White House and granted anonymity to speak freely.

But Biden’s stubbornly poor polling and the stakes of the election “are creating the freakout,” he said.

Let's be honest about what's really got Democrats losing their minds at the moment. It's not just that Biden is lagging in the polls due to his terrible tenure as president. It's that their lawfare gambit appears to be failing. It's not just the possibility of a conviction backfiring that has them needing smelling salts, though. Democrats are facing another outcome that could prove catastrophic.

Several months before this writing, I made the case that no one seemed to be considering what would happen if Trump avoided a conviction in his New York criminal trial. Given the absurdity and weakness of DA Alvin Bragg's case, that is now a distinct possibility despite the far-left judge's best efforts. When the star witness against the defendant admits to grand larceny on the stand, things aren't exactly going well.

Maybe it's all rigged, but what if it's not? What if there's at least one juror who slipped through and sees the case for what it is? A hung jury is not at all out of the question at this point.

Will that happen? I don't know, but what I do know is that Democrats are starting to feel the pressure of the possibility, and they are cracking under it. Their "pervasive sense of fear" is driven by the fact that their lay-up bounced off the rim. This wasn't supposed to be close. Trump wasn't supposed to be consistently leading Biden. Their lawfare was supposed to be their ace in the hole, with a conviction in every case assured.

If that doesn't work, what else do they have? The other three criminal cases appear to have little shot of happening before the election, and Biden has no record to run on in. That leaves only the desperation heave of replacing the president at the DNC convention, something that would seem impossible unless he voluntarily steps aside. Let's just say Jill Biden will never let that happen. 

Things could change, but as they stand in late May, Democrats have every reason to be experiencing a "full-blown freakout." That Politico, a left-wing publication, is putting an army of reporters on such a story is evidence of just how bad it's gotten.

 Palestine will be free!” chant the protesters. “From the river to the sea!”

Some say that’s a call for genocide—another Holocaust—and elimination of Israel and all Jews.

So, should the chant be illegal?

The House of Representatives just voted to make it illegal at universities. Both Republicans and Democrats voted for the bill.

In Canada, politicians go further. Prime Minister Justin Trudeau wants people “advocating genocide” sentenced to life in prison.

“We’re a laboratory of bad ideas,” says Canadian Ezra Levant in my new video.

Levant, founder of Rebel News, asks: “Who’s going to determine who’s going to be prosecuted? A law like that gives a politician the chance to criminalize his peaceful opponent!”

Canadian politicians already do that.

“I wrote a [critical] book about Justin Trudeau,” says Levant, “a knockoff of ‘The Sopranos.’ I called it ‘The Libranos’ because he’s with the Liberal Party. He hated that book. … And so, I was prosecuted.”

Levant was called before investigators working a government organization that polices “unregistered political advertising.”

“They fined me,” he says. “Five years later, I’m still in court over a book that criticized Justin Trudeau.”

“Canadians must like this,” I tell him. “Trudeau gets reelected.”

“A lot of Canadians and Americans and Brits,” he sighs, “want a net nanny—for the other guy.”

Brazil already has that.

A judge there recently ordered X, formerly Twitter, to block the accounts of people who support the former Brazilian president.

Elon Musk, who owns X, refused. He said: “We will probably lose all revenue in Brazil and have to shut down our office there. But principles matter more than profit.”

Good for Musk.

A new law in Scotland says that “misgendering” someone, like calling a trans woman “he,” can get you seven years in jail.

“Freedom of speech and belief are at an end,” responded “Harry Potter” author J.K. Rowling.

The day Scotland’s new law took effect, Rowling intentionally broke it by misgendering people on X, saying, “I look forward to being arrested.”

By law, she should have been.

Last year, British police arrested thousands of people for “spreading hate” on the internet.

“J.K. Rowling has the wealth to fight a strong defense,” Levant points out. “She and Elon Musk are the two people in the world who have done more to stop cancel culture.”

Being “canceled” shouldn’t be an issue in America. Our First Amendment says, “Congress shall make no law … abridging the freedom of speech.”

Should that “River to the Sea” House bill become law (by also passing the Senate and being signed by the president), it would be something new.

Americans have mixed feelings about free speech. A RealClearPolitics poll reports that 61% say they believe government should restrict hateful posts. Yikes. Government? Will the party in power get to decide what’s “hateful”?

“I don’t think you reduce hate when you police it in that way,” says Levant. “The ability to speak the truth is a more pressing value. Even if we’re going to hurt a feeling, even if we’re going to upset the apple cart, that’s what freedom of speech means. It trumps other values. Give people that peaceful outlet for their grievance.”

“If you cork them up, if you don’t let them have the safety valve of free speech, they’ll explode in another way, possibly including violence. … Free speech is a preventive mechanism that prevents an escalation of problems.”

I agree. It’s good that so far, American police say their campus arrests are for trespassing or property damage, not words.

I don’t agree with what most of the demonstrators say.

But I’ll defend their right to say it.

The trial of Donald Trump on jerry-rigged charges produced the foreordained outcome. Trump was found guilty by a Manhattan jury of 34 felony charges. It couldn’t have been otherwise. This was a show trial.

It would have been more efficient — it would have saved a day or two in show time — if Judge Merchan had simply directed a verdict of guilt and sent the jury home when the parties’ rested. It would not have been more unconstitutional than having the jury pick from Column A, Column B, or Column C for the “other crime” that was vital to the case.

Instead Merchan let the prosecution run wild. He constrained the defense. He all but stripped Trump’s defense to the charge of federal election misconduct to which Michael Cohen had pleaded guilty.

He gagged the defendant. He excluded evidence that might have helped the defendant, say with respect to the allegation of misconduct under federal election law. He crafted jury instructions that adopted the show-trial theory of the case.

And the jury performed predictably under the circumstances. In this case its role was ministerial. The guilty verdict on each of the 34 charges was for show.

The show trial lacked certain elements of the Stalinist show trials of old. Most notably, the defendant did not confess or repent. He has not professed to accept the opinion of his accusers. He may even prevail at some point on appeal after the election.

But appeal is irrelevant. As in the show trials of old, the point of the case is political, not legal. Democrats have achieved their immediate political objective. Trump is now a convicted felon.

As if to put an exclamation point on this aspect of the case — for dummies — Judge Merchan has scheduled sentencing four days before the Republican convention this coming July. The finality of the verdict on each of the charges yesterday is only seeming. The show’s not over in this show trial.

The Democrats are guilty of every sin they attribute to Trump. Election interference — this is how it’s now to be done, with a strong dose of humiliation, a patina of legality, and the threat of incarceration. The threat produces an erotic effect on the Democrats and their media allies, but that is not the point. The point is to take down a political adversary. The point is the electoral effect — the point is political.

The Democrats lack confidence in their ability to defeat Trump at the polls. The point of the rigged trial is the rigged election, and not in the “who’s voting” or “who’s counting the votes” departments, although there is that too. The intended audience of the show trial is the few voters who occupy the middle of the road and could go either way in November. If they move them to one or two or three percent to Biden, as seems plausible and even likely, that is the point. This is the Democrats’ objective in the medium term. Intelligent readers can draw a straight line to infer the long-term objective.

Every metaphor descriptive of what is happening here falls short of the moment. “Crossing the Rubicon,” “sowing the wind,” and so on, have a remote and clichéd quality that fails to capture what the Democrats have done. In political terms, one might think of Aaron Burr and Alexander Hamilton. But that is too remote as well.

One has the sense that Democrats do not fully grasp what they have done. If the Democrats’ show-trial moves only enough voters to swing the election to Biden — a not implausible outcome that is what the case is all about — how can the outcome be acceptable to the many who understand what the Democrats have done. The show-trial bears seeds of alienation, discord, turnabout, and violence. That is the point buried in the clichéd metaphors. That is the implication of the conviction rendered in the show-trial.

Remember that catchy NYC tourism campaign, “I loooove New Yoork!” I can almost picture President Biden croaking out the catchy tune, but with one word changed: “I loooove Iraaan!”

Iran is the number one state sponsor of worldwide terrorism. They call America the ”Great Satan,” and their stated goal is to wipe Israel off the map. But don’t tell that to Joe Biden, who doesn’t want to upset the Mullahs in case it might hurt his increasingly remote reelection chances. The befuddled octogenarian president actually is demanding that European countries concerned about the Islamic Republic’s nuclear weapons program stand down and refrain from telling the truth—which is that Iran must never, ever get its hands on nuclear weaponry.

In his desperate attempt to hold onto power, he’s even undermining two of our closest allies in the world, Britain and France, as the Wall Street Journal reports in an exclusive:

Joe Biden is opposing a European plan to rebuke Iran for advances in its nuclear programme as Washington wants to avoid an escalation of tensions ahead of the US presidential election, diplomats involved in discussions have claimed.

The Biden administration is said to be arguing against an effort by Britain and France to censure Iran at the International Atomic Energy Agency's member state board in early June, they added. While US officials deny lobbying against a resolution, the diplomats say the administration is pressing other countries to abstain in a censure vote, which is what Washington will do.

On Monday, the U.N. atomic-energy agency reported that Iran’s stockpile of 60% highly enriched uranium rose 20.6 kilograms to 142.1 kg as of May 11 from three months earlier, its highest level to date.

U.S. officials say that material could be converted into weapons-grade enriched uranium in a matter of days. It would then be enough to fuel three nuclear weapons…. [Emphasis mine.]

European diplomats have warned that failure to take action would undermine the authority of the IAEA, which polices nonproliferation of nuclear weapons. They say it also weakens the credibility of Western pressure on Iran. And they are frustrated over what they see as U.S. efforts to undermine their approach.

Biden—and before him, his predecessor, Barack Obama—have repeatedly failed to show strong leadership in confronting Iran, even as Biden undermines our ally Israel at every turn while the Jewish state fights for its very survival in its war against Hamas. In his cold calculation, the permanently dazed president appears to be putting his reelection concerns above American security—indeed, above the safety of the entire world order. And that is truly "deplorable."
